Terms of Service

These Terms of Service (the “Terms”) constitute an agreement between you and CCVillage LLC, doing business as Child Care Coach (“Child Care Coach,” “we,” “us,” or “our”). These Terms govern your access to and use of the Child Care Coach website, membership resources, online community, training materials, coaching sessions, workshops, physical products, and other products or services we make available (collectively, the “Service”).

By purchasing a membership or product, creating an account, accessing membership content, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 18 years old and able to enter into a binding agreement to create an account or purchase the Service.

Child Care Coach provides child care planning, business-management, professional-development, and educational resources. Depending on your membership or purchase, these resources may include:

• business form templates and operational resources;
• food menus and recipes;
• curriculum plans and activity instructions;
• coloring sheets, activity sheets, patterns, certificates, visual aids, and other printable materials;
• training courses, workshops, coaching sessions, and recorded presentations;
• access to an online community; and
• physical materials, including the Child Care Coach Book of Operations and Curriculum Library.

The specific features, resources, and benefits included with each membership, program, or purchase are those described at the time of purchase. Some products or services may also be governed by additional written terms presented with the applicable offer. Agency and organizational purchases may be governed by a separate agreement.

You agree to provide accurate and current information when creating and maintaining your account. Your account and login credentials are issued to you individually and may not be sold, transferred, or shared with another person.

You are responsible for maintaining the confidentiality of your login information and for activity occurring through your account. You agree to notify Child Care Coach promptly at support@childcarecoach.com if you know or suspect that your account, password, or payment information has been lost, stolen, disclosed, or used without authorization.

You may access your account through more than one device. Access from different computers, phones, tablets, locations, or internet connections does not by itself violate these Terms.

Child Care Coach materials are licensed, not sold. Subject to these Terms and payment of all applicable fees, Child Care Coach grants you a limited, non-exclusive, non-transferable license to access and use the materials included with your membership or purchase.

Unless Child Care Coach agrees otherwise in writing, one individual membership covers one family child care group or one classroom or child group within a larger program (the “Covered Group”). A separate membership is required for each additional classroom, child group, program, or facility.

You may:

• access the materials and services included with your current membership or purchase;
• download, print, reproduce, and store materials for use with the children, families, and business operations of the Covered Group;
• customize forms and other materials when they are provided as customizable resources;
• allow employees or assistants working directly with the Covered Group to use printed materials on behalf of that group; and
• continue using copies of materials lawfully downloaded or printed while your membership was active.

Cancellation or expiration of a membership ends access to members-only areas, new materials, updated materials, coaching, workshops, and other ongoing membership benefits. It does not require you to destroy materials lawfully downloaded or printed while the membership was active. Your continued use of those materials remains subject to these Terms.

Except where Child Care Coach gives written permission or applicable law expressly permits otherwise, you may not:

• share your login credentials or allow another person to use your membership account;
• give, sell, sublicense, publish, upload, transmit, distribute, or otherwise provide Child Care Coach materials to another classroom, child care group, provider, program, facility, business, membership organization, resource library, or website;
• use one membership to supply materials to more than one Covered Group;
• resell Child Care Coach materials or include them in any product, membership, course, collection, database, or service offered to others;
• remove or obscure copyright, trademark, branding, attribution, or proprietary notices;
• modify materials other than resources intentionally provided for customization, or claim Child Care Coach materials as your own creation;
• create derivative products from Child Care Coach materials for distribution or commercial sale;
• scrape, systematically download, archive, or use automated methods to collect substantial portions of the Service;
• frame, mirror, reproduce, or display Child Care Coach webpages or members-only areas on another website or service;
• upload Child Care Coach materials to another server, platform, shared drive, social media group, or online community for access by others; or
• use the Service in a manner that interferes with its operation, security, or use by other members.

Nothing in these Terms limits rights that cannot lawfully be restricted.

The Service and its content—including text, designs, form templates, curriculum, menus, recipes, graphics, printables, videos, training materials, website content, trademarks, and other resources—are owned by or licensed to Child Care Coach and are protected by copyright, trademark, and other intellectual-property laws.

No ownership rights are transferred to you through a membership, purchase, download, or use of the Service. All rights not expressly granted in these Terms are reserved by Child Care Coach.

Access to the Child Care Coach online community may be available to both free and paid members. Community access does not by itself include a paid Child Care Coach website membership, Complete OS membership, or any other paid product unless expressly stated.

Participation in the community is subject to the Community Guidelines and any platform rules presented within the community. You agree to communicate respectfully, protect the privacy of children and families, avoid unauthorized advertising or promotion, and refrain from posting unlawful, abusive, misleading, infringing, or disruptive content.

Child Care Coach may moderate, move, restrict, or remove community content and may limit or revoke community access when reasonably necessary to enforce these Terms or the Community Guidelines.

Community levels, points, leaderboard positions, recognition, and occasional rewards are participation features. They do not create a promise of compensation, prizes, paid membership benefits, or future rewards unless Child Care Coach announces specific terms for a particular promotion.

You retain ownership of original content you submit to the Service, including posts, comments, questions, photographs, files, and other materials (“Member Content”).

By submitting Member Content, you grant Child Care Coach a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and distribute that content only as reasonably necessary to operate, moderate, maintain, and promote the community or Service in which you submitted it. This license does not transfer ownership of your Member Content to Child Care Coach.

If Child Care Coach wishes to use your Member Content outside the Service in advertising, paid products, publications, or other unrelated commercial materials, we will request additional permission unless the content was submitted under separate terms that expressly authorize that use.

You represent that you own or have permission to submit your Member Content and that doing so does not violate another person’s privacy, confidentiality, copyright, trademark, or other rights. Do not post identifying information, photographs, records, or other private information concerning a child or family unless you have all permissions required to do so.

Coaching calls, workshops, question-and-answer sessions, and other live events may be recorded and made available to members. When a session is being recorded, Child Care Coach will provide notice through the event description, an announcement, or the recording indicator used by the applicable platform.

If you participate by speaking, appearing on camera, sharing your screen, or submitting a question during a recorded session, your contribution may be included in the recording. You may participate without appearing on camera and may submit a question through available private or written methods when offered.

You may not independently record, reproduce, publish, or distribute live sessions or member-only recordings without written permission from Child Care Coach.

Child Care Coach may offer monthly memberships, annual memberships, one-time purchases, and other payment arrangements. The price, billing frequency, and included benefits will be displayed at the time of purchase.

When you purchase a recurring membership, you authorize Child Care Coach and its payment processor to charge the payment method associated with your account at the beginning of each billing period until you cancel.

Monthly memberships automatically renew each month on or near the calendar day on which the membership was purchased. Annual memberships automatically renew each year on or near the anniversary of the original purchase date. A product identified at checkout as a one-time purchase will not automatically renew.

You are responsible for maintaining accurate billing information and a valid payment method.

Promotional, introductory, legacy, agency, and specially negotiated prices may differ from currently advertised prices and may be subject to separate conditions disclosed when offered.

Child Care Coach may change its membership options, included features, schedules, or prices from time to time. We may add, replace, update, or discontinue particular materials or benefits as the Service develops.

Any price change affecting an existing recurring membership will be communicated in advance and will apply beginning with a future renewal. If you do not wish to continue at the new price, you may cancel before that renewal. Continuing the membership after the new price takes effect constitutes acceptance of the new price.

If a payment is declined or cannot be processed, Child Care Coach or its payment processor may attempt to process the payment again. Child Care Coach may suspend access to some or all paid membership benefits while payment remains outstanding.

If payment is not successfully completed, Child Care Coach may cancel the membership and terminate access to paid membership benefits. You remain responsible for charges validly incurred before cancellation.

You may cancel a recurring membership at any time through your online account or by emailing support@childcarecoach.com.

Cancellation stops future renewal charges. Unless otherwise stated, you will continue to have access to the benefits included with your membership through the end of the billing period for which you have already paid.

Submitting a cancellation does not automatically refund charges already processed. You are responsible for cancelling before your next renewal date if you do not want the membership to renew.

Child Care Coach will send or provide confirmation when a cancellation has been processed. If you request cancellation by email, retain the confirmation for your records.

Membership fees are generally nonrefundable once charged, including monthly and annual renewal payments. Child Care Coach does not ordinarily provide prorated refunds or credits for partially used billing periods, unused membership benefits, failure to access the Service, or failure to cancel before a renewal date.

Child Care Coach may issue a refund, partial refund, credit, or other adjustment at its discretion or when required by applicable law. Granting an exception in one instance does not create an obligation to grant the same or a similar exception in another instance.

Cancellation does not affect your right to continue using materials lawfully downloaded or printed while your membership was active, subject to the license and use restrictions in these Terms.

Physical products and specially contracted services may be subject to separate shipping, replacement, cancellation, or refund terms disclosed at the time of purchase.

Child Care Coach may suspend, restrict, or terminate your account or access to all or part of the Service if:

• you fail to pay amounts due;
• you share an account or materials without authorization;
• you infringe Child Care Coach intellectual property or the rights of another person;
• you materially or repeatedly violate these Terms or the Community Guidelines;
• your conduct threatens the security, operation, integrity, or members of the Service; or
• suspension or termination is reasonably necessary to comply with law or protect Child Care Coach, its members, or others.

When practical under the circumstances, Child Care Coach may provide notice and an opportunity to correct a violation before termination. Serious, intentional, repeated, unlawful, or security-related violations may result in immediate action.

Termination for a material violation may revoke the license granted under these Terms and may require you to stop using and delete Child Care Coach materials in your possession. Fees already paid will not be refunded when access is terminated for cause, except when required by applicable law.

Child Care Coach provides planning tools, educational resources, form templates, menus, activities, professional-development materials, and business-support information. You are responsible for deciding whether and how to use these resources in your own program.

You are responsible for selecting foods, activities, equipment, policies, forms, supervision practices, and procedures appropriate for the children in your care and for adapting materials to individual needs, allergies, abilities, ages, cultural considerations, program conditions, and applicable requirements.

You are also responsible for confirming and complying with the licensing, food-program, employment, tax, insurance, safety, recordkeeping, and other requirements applicable to your program and location.

Child Care Coach works to maintain reliable access to the Service but does not guarantee that every part of the Service will always be available, uninterrupted, secure, or error-free. Access may be delayed, limited, or interrupted by maintenance, updates, internet or hosting failures, third-party platforms, payment processors, equipment failures, power failures, natural events, emergencies, or other circumstances beyond our reasonable control.

Temporary interruptions do not ordinarily entitle a member to a refund. If a substantial interruption materially prevents delivery of a paid service, Child Care Coach may provide an extension, replacement access, credit, refund, or other reasonable adjustment at its discretion.

The Service may use or link to third-party websites, platforms, payment processors, community services, video services, or other resources. Your use of a third-party service may also be governed by that third party’s terms and privacy practices.

Child Care Coach does not control and is not responsible for the availability, security, accuracy, content, policies, or actions of independent third-party services. A link or integration does not necessarily constitute an endorsement. You use third-party services at your own discretion.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED AVAILABILITY.

Child Care Coach does not guarantee a particular licensing outcome, food-program determination, business result, enrollment level, income level, educational outcome, or other result from using the Service.

Child Care Coach form templates are designed to help you put your own policies and procedures into practice. They are not a substitute for the advice of an attorney or qualified financial professional.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, CHILD CARE COACH AND CCVILLAGE LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR SIMILAR LOSSES ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF CHILD CARE COACH AND CCVILLAGE LLC FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO CHILD CARE COACH FOR THE APPLICABLE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Child Care Coach may revise these Terms as the Service, business, or applicable requirements change. The updated Terms will be posted on the Child Care Coach website with a revised “Last updated” date.

If a change materially affects an existing recurring membership, Child Care Coach will provide reasonable notice through email, the website, the member account, or the community. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those Terms. If you do not agree to a material change, you may cancel your membership before the change takes effect.

By creating an account or purchasing the Service, you consent to receive account, billing, transaction, security, policy, and service-related communications electronically. These operational communications are separate from optional marketing messages.

You are responsible for keeping your email address current and for reviewing communications sent to the address associated with your account.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

These Terms, together with the Privacy Policy, Community Guidelines, and any additional terms expressly presented with a particular purchase, constitute the entire agreement between you and Child Care Coach concerning the Service covered by them.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. Failure by Child Care Coach to enforce a provision does not waive the right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without written permission from Child Care Coach. Child Care Coach may assign these Terms in connection with a merger, reorganization, sale of assets, change of control, or transfer of the business.

Section headings are provided for convenience and do not affect interpretation. Provisions that by their nature should continue after cancellation or termination—including intellectual-property, license-restriction, disclaimer, liability, and general provisions—will survive.

Participation in the Child Care Coach community’s referral program through Skool is subject to the terms and program details presented on Skool. Community membership, levels, points, or leaderboard placement do not automatically create affiliate eligibility or a right to compensation.
